OFCOM addresses “small print” issue
OFCOM has issued guidance to communications providers on how it thinks the law applies to the extra charges consumers may have to pay on top of their usual bill. A Youtube video aimed at consumers is also provided on the web site.
This seeks to clarify OFCOM’s view of how the law applies to things like charges for different payment methods, itemised billing or early termination of contracts.
More details are available in the Executive Summary and there is also a FAQ. In essence it is all about whether terms are “core” or not, leaving them free of fairness tests, and whether non-core terms are fair. If the sums charged are justifiable and clearly notified to the consumer then they are likely to be fair.
A printable guide for consumers can be downloaded that highlights things to look out for when shopping around.
Only time will tell if this makes any difference. As an example, a Virgin Media customer wishing to receive a paper bill and pay other than by direct debit will be charged an additional £6 per month which many might regard as “unfair” but by advertising it in accordance with OFCOM’s guidance it may be beyond challenge.
